Can I change my employee’s resignation date?

“Sam has resigned and given me two weeks’ notice. I really don’t need him for two more weeks and would prefer to tell him to leave right away. Is that okay?

You can certainly let Sam stop working earlier than his original resignation date. However, if you change Sam’s resignation date in any way, you will turn a resignation into a termination… and he’ll be eligible for unemployment.

So, what can you do? Consider having Sam stop working immediately but paying him through his resignation date. It’s worth it to no longer have him in the workplace and still maintain this as a resignation.

On a side note, be sure to get any resignation immediately in writing… including an effective date. Once you have a date, you can hold the employee to it. Lock it in by replying, in writing, your acceptance of his written or verbal resignation and confirming the date.
